Landlord loses $33,000

In a recent case, the landlord gave notice to the tenant for landlord use of property. The landlord did not move in and the tenant commenced an application with the RTB. The landlord claimed that his spouse did move into the house within a few weeks after the tenants had vacated it. While acknowledging that his spouse then moved out five months later, the landlord argued that this was because she felt spied upon by the tenants and uncomfortable because of a lack of privacy. The RTB found there were no extenuating circumstances to excuse the landlord’s non‑compliance

The RTB awarded the tenant $33,000 (12 months’ rent) as compensation.
